Is 3 saying gray is not a color ? It is a color. It's one of our possible perceptions of many light spectra.
Colors only exist in our brain and don't refer to any specific spectrum, so if we can distinguish it, it's a color.
For example yellow can be seen from a pure white yellow source or red+green. Or white from a full spectrum or weak red+green+blue.

So 3 is a sassy guy. I don't know how I feel about the rebus bubbles (rebubbles) -- on the one hand it makes sense to give the reader a way to know what he's thinking since he's getting to be the focus character; on the other hand he loses a bit of his mystique by not talking in static anymore.

Three's bubbles are understandable now because the chapter is from his perspective.
It's possible that Mr. Smile can understand him, but that's not the reason why the pictographs are shown (rather than static).

If you take the circle to the right, and then average everything out until it is homo-geneous, then you get something similar to the circle on the left. You don't have to talk about it if you don't want, I know people get weird about hermaphrodites, but I think you might actually have lots of colours. All of them maybe!
Well, I just... I hope you go to a specialist to get your colours tested. It could go badly for you if you secretly had colours for your whole life and didn't know...

As a literary device, this works well. There's no reason to not show us what Three is saying if not showing us adds nothing to the story (like how Three interacts with Tobi). When he's on his own, or when the intended dialog might reveal more about a character before it's time, static bubbles are definitely more appropriate. They're also completely appropriate when we're reading the story from Tobi's perspective.
