@ Giovanni: They seem a little short for high-heels. I suspect that they're supposed to be standard leather dress-shoes.
Those normally have a sole that only has points of contact with the ground around the balls and heel of the feet. The sole near the balls of the feet forms the base of the sole, with the sole at the heel developing a small platform. This forms a small gap between the ground around the middle of the foot.

Someone already touched on the fact that he needed to be stopped, but another aspect to consider is once you commit a "wrong" in combat, you give up a lot of "rights".
In a war, if you wave the white flag only to ambush the other side trying to accept your surrender without further bloodshed...well, they kind of need to ignore further white flags, now don't they? It's not an absolute, but once one side shows they're willing to go low, the other needs to deal with it somehow.
In this case...if Morty's alive, then Burk dealt with it appropriately. Morty has already been shown not to honor a surrender, so now the only way to take him in alive is in a state where he can't just change his mind and use his powers again.
