The judge wasn't the person Burk was looking for, and he did promise not to attack anyone while inside the castle. So running away was the best way to end the fight under the circumstances.

The Baron and Moe knew each other on a first-name basis, which does raise some eyebrows on its own, so it's not surprising there were other questionable magic users down in that prison. And don't forget the one super-powerful prisoner who refused to come out of their cell...
